Double Jeopardy And Criminal Charges

Categories: Legal and Law | June 2nd, 2008 | by admin | no comments

The concept of double jeopardy stems from a clause in the Fifth Amendment to the United States Constitution which states that:

“No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury […] nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”

Who Can Sue Your Business Under The Ada

Categories: Legal and Law | June 1st, 2008 | by admin | no comments

Title III of the ADA was intended to remove barriers and make places of public accommodation for all type of individuals with disabilities and not just those that are wheel chair bound. The primary focus under the ADA is persons with physical disabilities and includes a very broad range of disabled individuals.

The congressional committee reports and the Justice Department look to a comparison between a disabled person and an average person. Horror Stories About Motherhood - True Or Lies

Categories: Legal and Law | May 26th, 2008 | by admin | no comments

Before I became a mother, I read a lot of motherhood stories and heard a lot of horror stories about how one would literally lose their lives after becoming a mother. I never knew how far the truth was, to be honest. I’ve, of course, watched my mom carry the weight of being a mother to us, three monstrous (but lovable) kids and also babysat for many other people’s kids at the same time! Frankly, I don’t know how she did that and for those of you who are doing that, my hats off to you.

Court Watch - Keep An Eye On Whether The Uspto Appeals A Decision Barring Rules Changes

Categories: Legal and Law | May 11th, 2008 | by admin | no comments

In April, the District Court for the Eastern District of Virginia barred the U.S. Patent and Trademark Office from instituting the sweeping rules changes it proposed to limit the number of continuing applications, requests for continued examination (RCEs), and claims that an applicant could make. Even so, it is important to keep an eye on this case. The USPTO is considering an appeal.

The case stems from a proposal that was to take effect Nov. 1, 2007. Among the new provisions, applicants would have been limited to two continuations or continuation-in-part applications and one RCE after the first application. Applicants also would have been restricted to submitting 25 claims, five of which could be independent. The old rules, which remain in effect, allow for an unlimited number of continuing applications, RCEs, and claims.

How Terrorist Groups Use Drug Trafficking To Finance Their Terror Operations

Categories: Legal and Law | May 8th, 2008 | by admin | no comments

Terrorism has always been linked with other forms of crime. But the most notable link is the one between terrorism and guerilla organizations and illicit drug trafficking. There are various examples that support this. Take the case of Colombia where cocaine drug lord Pablo Escobar joined hands with The National Liberation Army or the ELN guerillas to execute series of car bombs in 1993. The Basque ETA has been linked with a Spanish terrorist organization and a Columbian drug cartel for a bomb explosion in front of the Department of Administrative Security in Bogota. This proves that there is a link between drug traffickers and terrorist organizations.

There are Only Solutions with the Law of Attraction

Categories: Legal and Law | April 9th, 2008 | by admin | no comments

Do you focus on the problem or the solution? It makes a big difference when using the LOA.

My dad used to have a parrot, Jacques, that would mimic anything said. We kept him in the florist for everyone to enjoy. One of our co workers, Joey was particularly fond of Jacques and volunteered to feed him each evening when everyone had left work for the day. Joey was a nice, kind person but we found Jacques each morning saying the same thing over and over again, “I have a problem! I have a problem! I have a problem!” Jacques was mimicking the very words that Joey was famous for saying. He started every sentence with, “I have a problem” when there wasn’t even a problem to be had. We noticed that he did begin to have problems… all the time. Between the parrot and him, we began to get tired of hearing, “I have a problem!” especially from the parrot.
